BANJARBARU - The public prosecutor (JPU) of the Banjarbaru District Attorney's Office has demanded that Firly Nurachim, a defendant in the case of the expiration of Micro, Small and Medium Enterprises (MSMEs) Mama Khas Banjar, be released from all charges at the follow-up trial at the Banjarbaru District Court, South Kalimantan.

"Demanding the defendant Firly to be released from all charges," said Public Prosecutor Febriana Rizky as quoted by ANTARA, Monday, May 19.

On this charge, the Chief Justice of the Panel of Judges, Rakhmad Dwinanto, then asked the defendant to make a written defense or plea at the next trial which was scheduled for Monday (26/5).

Firly's attorney, Faisol Abrori, welcomed the prosecutor's demands for his client and hoped that the judge could decide as fairly as possible.

He said the charges to be released from the demands or called onslag were appropriate because no criminal offenses were found.

According to Faisol, all legal remedies including presenting MSME Minister Maman Abdurrahman as an amicus stealae or a court friend at the previous trial managed to convince the public prosecutor to sue his client to leave.

"The prosecutor has opened up that this case is not a criminal offense, but administratively as the government's spirit of fostering MSMEs," he said.

Previously, it was known that the defendant Firly as a micro business actor was criminally charged for selling various kinds of frozen food, packaged food and bottled drinks that did not include an expiration date.

The prosecutor charged Firly with the first indictment of Article 62 paragraph (1) Jo. Article 8 Paragraph (1) letter g of Law of the Republic of Indonesia Number 8 of 1999 concerning Consumer Protection.

Then the second indictment, Article 62 paragraph (1) Jo. Article 8 Paragraph (1) letter i of Law of the Republic of Indonesia Number 8 of 1999 concerning Consumer Protection.

However, recently this case has been crowded and has become the attention of MSME Minister Maman Abdurrahman so that Firly is released, because it is more appropriate to use the Law on Food by prioritizing coaching, not criminally.
